GENERAL CONDITIONS OF SALE OF E-TICKETS FOR THE MUSÉUM NATIONAL D’HISTOIRE NATURELLE – JARDIN DES PLANTES

 

 

Any order for a TICKET from the online ticket office on the www.billetterie.jardindesplantesdeparis.fr internet site of the Muséum National d'Histoire Naturelle, hereafter "The Museum", a public scientific, cultural and professional establishment, will be exclusively governed by these general conditions of sale.

The website, source code, texts, images and other elements of the website are the exclusive property of the Museum.

The entire content of the website is protected by copyright law. For this, and in compliance with the provisions of the Code for Intellectual Property, the website is authorised for private use only. Otherwise, the offender is liable to prosecution before the competent court.

 

ARTICLE 1 - ACCEPTANCE OF THESE GENERAL CONDITIONS OF SALE

Any physical person who places an order, hereafter "the Customer", acknowledges that they have read these general conditions of sale prior to the validation of their order. Any validation of the order shall without exception constitute acceptance of these general conditions of sale. Accordingly, the Customer declares and acknowledges that they have perfect knowledge of these general conditions of sale and thereby waives the right to invoke any contradictory document.

The Museum reserves the right to unilaterally adapt or modify these general conditions of sale at any time. In the event of modification, the general conditions of sale in force on the day the order is placed will be applied.

 

ARTICLE 2 - IDENTIFICATION OF THE OFFEROR

2.2 Customer Service

Customer Service is available from Monday to Friday from 9:30 a.m. to 4:00 p.m. exclusively for questions concerning problems with the validation of an order (payment, reception of tickets) or the management of your personal data.

ARTICLE 3 - TICKETS OFFERED FOR SALE

3.1 Services granted to TICKET holders 

TICKETS purchased on line are available for the Museum sites presented on www.billetterie.jardindesplantesdeparis.fr. They are only valid for individual visits.

 

Each TICKET purchased gives right of access exclusively for the site reserved and indicated on it.

 

3.2 Duration of the validity of the TICKETS delivered

Each TICKET delivered is exclusively valid for the date and, if applicable, the time indicated on the ticket or for a period defined when placing the order, depending on the service.

 

ARTICLE 4 - RATES FOR VISITS AND PRICE OF THE ORDER

Several rates are offered depending on the site of the visit and the visitor's age or status.

Price conditions are those presented on www.billetterie.jardindesplantesdeparis.fr at the time of placing the order.

TICKET rates and the total price of the order are indicated in Euros.

Rates are subject to current VAT rates applicable to zoos, museums, monuments and exhibitions. 

The Museum reserves the right to modify its admission rates at any time. The applicable rates are those announced on the e-ticket website at the time of placing the order.

ARTICLE 5 - ORDERING

The Customer orders one or more TICKETS offered for sale on www.billetterie.mnhn.fr.

The procedure for placing an online order comprises the followings steps:

1/ The Customer selects the visit.

The Customer chooses the rate and the number of admissions desired per rate, and the day and/or hour of the visit for dated / time-stamped offers depending on the number of places available. When placing the order, the Customer is informed in real time of the availability of the TICKETS they select.

2/ The Customer creates a Customer account secured by login credentials, by entering their electronic mail address and a password.

The creation of the Customer account implies the communication of the necessary and obligatory information for the treatment of the future order: name and first name, telephone, email address.

3/ A summary covering the entire order is displayed.

After checking their selection of products and reading these general conditions of sale, the Customer then performs the online payment of their order by securely communicating their bank details (numbers, bank card validity dates and visual cryptogram).

In case of refusal by the payment centre concerned, the order is automatically cancelled.

Any payment of the order by the Customer constitutes irrevocable acceptance of the order which cannot be questioned.

4/ The ticket(s) ordered will be sent as a PDF attachment via electronic mail to the email address entered by the Customer. It is the Customer's responsibility to ensure that the details given when placing the order are correct.

By connecting to their account, they will be able to view their order and download the ticket(s) ordered.

5/ Printing tickets

The Customer will be able to print the ticket(s) downloaded in PDF format after validation of their purchase. They will receive a link by email that will enable them to print the TICKET(S) later.

The Customer must print as many barcodes (tickets) as there are persons and tickets.

The printed ticket is only valid if it is printed with a laser or ink jet printer in portrait format (vertical A4) on recto-verso blank paper without modifying the font size. Good print quality is required. In case of an incident or poor print quality, the Customer must print their TICKET(S) again. The barcodes printed on the tickets must in no case be concealed from the optical reading performed when entering the exhibition.

The ticket may also be presented in PDF format on a smartphone or tablet. To facilitate reading, the brightness of the screen must be set to its maximum.

 

 

ARTICLE 6 - MODES OF PAYMENT

6.1 Nature of the payment

The Customer must pay for the TICKETS exclusively in Euros and by bank card. The following cards are accepted: CARTE BLEUE, VISA, EUROCARD and MASTERCARD.

6.2 The payment operation

The Customer guarantees the Museum that they possess any authorisation necessary to use the selected mode of payment when they validate the order.

The Customer's bank account is debited for the amount of the order on acceptance of the transaction by the payment centre.

In case of refusal by the payment centre, the order is automatically cancelled.

6.3 Invoice

At the time of payment, the Customer is informed via the "Windows box" where the https request was made of the possibility to print a "sales receipt" and will receive a purchase confirmation email if they have entered this information in the payment window.

6.4 Payment security

For any payment made for the order of ticket(s) on www.billetterie.mnhn.fr, the Museum uses the PAYZEN secure payment solution, which uses the TLS protocol (encryption of all information related to the card) and is subject to numerous approvals (PCI DSS certification, CB bank card accreditation, Visa Merchant agent accreditation). The Customer's bank details are thus protected because only the payment agreement codes issued by the bank are kept.

The Museum guarantees that the means of encryption and related services used to secure the transactions are subject to authorisation or a declaration in compliance with current legislation.

ARTICLE 7 - CONFIRMATION OF THE ORDER

7.1 As soon as the payment of the order is confirmed by the payment centre, the Customer will receive an email confirming their order issued by the Museum's online ticketing website.

7.2 The confirmation email acknowledges receipt of the order and contains the following information:

- the essential characteristics of the TICKET(s) sold (site of the visit, the date and time),

- the transaction number,

- the total amount of the order,

- the internet link to reprint the ticket(s).

 

ARTICLE 8 - CONDITIONS FOR THE USE OF TICKETS

All TICKETS are systematically checked on entry to the site by scanning the barcodes printed on the TICKET.

Only those TICKETS with perfectly legible barcodes and information will be accepted.

Any partially printed, soiled, damaged or illegible TICKET will not be accepted.

The TICKET is strictly personal and non-transferable.

The TICKET enables queue-cutter entry via a dedicated entrance without need to go through the ticket office unless otherwise indicated.

Any reduced rate TICKET must be presented with proof for this reduced rate as mentioned at the time of purchase of the ticket. The information is repeated on the downloaded ticket.

For this purpose, only the following valid documents shall be accepted: the EU identity card for admission at reduced rates related to age, the "Pass Education", or a full-price ticket whose indicated date of visit is less than three (3) months and the proof related to the establishment of a partnership agreement with the Museum.

The TICKET is only valid for the visit and the period indicated on it.

The TICKET must be kept until the end of the visit.

The Museum reserves the right to refuse entry to the site concerned in the case of the presentation of a ticket that does not respect any one of the conditions mentioned above.

ARTICLE 9 - FRAUDULANT USE - LOSS - TICKET THEFT

9.1 Fraudulent use of TICKETS

The Museum will refuse access to any bearer of a TICKET with barcodes that have already been scanned. Only the first person presenting a ticket will be admitted to the exhibition. They will be considered as the legitimate bearer of the ticket.

9.2 TICKET loss or theft

The Museum refuses any liability in case of the loss or theft of any TICKET(S) delivered, including within the premises of the site concerned.

 

ARTICLE 10 - CONDITIONS OF TICKET REFUND AND EXCHANGE

In compliance with article L 221-28 of the Consumer Code, the purchase of a TICKET is not subject to the legal right of withdrawal.

Any TICKET purchased may be neither returned nor refunded, even in the case of loss, theft or if it is forgotten at the time of the visit.

Due to any eventual security obligations which may be ordered, the Museum reserves the right to close or modify its opening hours.

In case of the cancellation of the service appearing on the TICKET, Customer Service will contact the Customer as soon as possible by electronic mail to inform them and to offer:

- either, insofar as possible, the postponement of the service concerned to another day and/or a different time using the same TICKET;

- or the refund of the TICKET concerned, specifying the procedure.

 

ARTICLE 11 - Responsibility

11.1. For the services

In compliance with article L. 121-20-3 of the Consumer Code, the Museum shall in no case be liable for any failure to perform or the improper performance of the services to which the TICKETS give access that is attributable either to the Customer, or to the unforeseen and insuperable act of a third party, or to a case of force majeure as defined in Article 12 of these general conditions of sale.

 

11.2 For the delivery of TICKETS

With the exception of a malfunction of the www.billetterie.jardindesplantesdeparis.fr website that is attributable to it, the Museum cannot be held liable for any anomalies that may occur when placing an order, or during the treatment, downloading or printing of a TICKET that is attributable either to the Customer, or to the unforeseen and insuperable act of a third party, or to a case of force majeure as defined in Article 12 of these General Conditions of Sale.

 

ARTICLE 12 –FORCE MAJEURE

The Museum cannot be held responsible for any failure to perform that is due to a case of force majeure considered as such by the jurisprudence of French courts and tribunals.

 

ARTICLE 13 - PROOF, STORAGE AND ARCHIVING

The digital records stored in the computer systems of the Museum or any of its service providers, under reasonable conditions of security, will be considered as proof of the sales contract, its date, and of the orders and payments made. 

The archiving of orders and invoices is performed on reliable and durable media in such a way as to constitute a faithful copy, in compliance with the article of the Civil Code.

 

ARTICLE 14 - PROTECTION OF PERSONAL DATA

The Customer is informed that their personal data collected via the ticketing website is used by the Muséum National d’Histoire Naturelle in their capacity as responsible for its treatment within the meaning of Regulation (EU) 2016/679 of 27 April 2016 (hereafter the "General Regulation on the Protection of Data").

When placing the order, the Customer is asked for the following personal data: name, first name, electronic address, post code, town and telephone number. Only the data identified by an asterisk is obligatory and necessary for processing. In default of this data, the Customer's order cannot be treated.

The Customer's personal data is collected for the following purposes:

  • the management of orders and relations with customers;
  • the distribution of the Museum's newsletters by electronic mail (on condition of prior acceptance by the Customer). The Customer may at any time unsubscribe by clicking on the unsubscribe link appearing in each email.

In this context, the legal basis for processing is either contractual to manage purchases, or consent-based for registration for the Museum newsletter. The recipients of this data are the services authorised by the Muséum National d’Histoire Naturelle and its sub-contracted service providers. No data transfer outside the European Union will be made.

Customer data is stored for a period of two (2) years from the Customer's last incoming contact or, in the case of a subscription to the newsletter, for the duration of the subscription.

In accordance with the act of 6 January 1978 amended, known as the "Information Technology and Freedom" act, and the General Regulation on the Protection of Data, the Customer has at any time an individual right of access, opposition, rectification, limitation, portability and deletion. The Customer may also give instructions concerning the use of their data after their death.

To exercise these rights, the Customer must send a request to the Delegate for the Protection of Data of the Muséum National d’Histoire Naturelle, accompanied by the photocopy of an identity document, either by email to dpo@mnhn.fr or by post to: Muséum National d’Histoire Naturelle – Direction des affaires juridiques et de la commande publique – Délégué à la protection des données - 57, rue Cuvier 75005 PARIS. Be sure to specify your name, first name and postal address and include a recto-verso copy of your identity document. If, after contacting the Museum, the Customer considers that their rights concerning their data are not respected, they may file a claim with the CNIL, the supervisory authority in charge of the respect of obligations for the protection of personal data.

 

The information collected via this form is the object of computer processing by the Muséum National d'Histoire Naturelle as the processor of orders and relations with its customers and for sending the Museum's newsletters and offers. 

In this context, the legal basis for processing is either contractual to manage purchases, or consent-based for registration for the Museum newsletter. The data identified by an asterisk is obligatory and necessary for processing. Your order cannot be treated without this data. The purpose of facultative information is to know you better and to improve the quality of the service offered to you.

The data recorded is intended for the establishment's authorised services as well as its sub-contracted service providers and may be supplied to our partners if you consent to it. It will be stored for a period of 2 years dating from your last incoming contact and, in the case of a subscription to the newsletter, for the duration of your subscription (you may unsubscribe at any time). No data transfer outside the European Union will be made.

In compliance with the current regulation concerning the protection of your personal data, you have a right of access, rectification, limitation, portability and deletion over your data. You also have the right at any time to oppose the use of your data for commercial prospecting. Moreover, you may also give instructions concerning the use of your data after your death. You can exercise these rights either by sending an email to the establishment's Delegate for the Protection of Data at dpo@mnhn.fr or a letter to the Muséum National d’Histoire Naturelle – Direction des affaires Juridiques – DPO, Hôtel de Magny, CP 24, 57, rue Cuvier 75005 PARIS.
